General Terms and Conditions

1. Scope
These General Terms and Conditions apply to all contracts for digital content in the form of eSIM profiles concluded by consumers within the meaning of Section 13 of the German Civil Code (BGB) via our online shop.
2. Contracting party
The contracting party is SilentSim – Owner: Sana Kachroudi EP Gülcemal (sole proprietorship), Heerbrook 10, 22589 Hamburg, Germany, Email: info@silentsim.de, Phone: 0172 1433535.
3. Subject matter of the contract
Provision of eSIM profiles digital content for activation on compatible devices. The customer is obliged to check the eSIM compatibility of the device before purchase.
4. Conclusion of contract
- The product presentation in the shop constitutes a binding offer to conclude a contract.
- By clicking “Buy now”, the customer accepts the offer and the contract is concluded.
- We confirm the contract by email and provide the eSIM data digitally.
5. Prices and payment
All prices are stated in euros. Small business regulation according to Section 19 UStG applies no separate VAT shown. Accepted payment methods include PayPal, Klarna, Visa, Mastercard, Apple Pay, Google Pay and other methods offered via Shopify Payments. Payment is due upon conclusion of the contract.
6. Digital delivery / provision
The eSIM is provided exclusively digitally for example as a QR code or activation data after payment — usually within minutes, at the latest within 24 hours. No physical delivery takes place.
7. Cancellation for digital content
For digital content, the right of cancellation expires as soon as we have started performing the contract and you have received the eSIM data in accordance with Section 356 (5) BGB. You will be expressly informed of this during checkout; your consent is required for the purchase.
8. Use and duty of care
- The eSIM may only be used on compatible devices and in accordance with device/network operator requirements.
- The customer is responsible for providing correct information, especially the email address, and for securely storing the eSIM data.
- Sharing, publishing or reproducing the eSIM data is prohibited.
9. Availability / technical requirements
Internet access and a compatible device are required for provision. Temporary restrictions due to maintenance, third-party disruptions or force majeure do not give rise to any claims.
10. Warranty
Statutory warranty rights apply. No warranty is provided for incompatibilities caused by the customer's devices, settings or locks imposed by the customer or network operator.
11. Liability
We are fully liable in cases of intent and gross negligence as well as in the event of injury to life, body or health. In cases of simple negligence, we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. No liability is assumed for lost profits, indirect damages or data loss.
12. Blocking / misuse
In the event of suspected misuse, fraud or unlawful use, we are entitled to refuse or revoke provision where necessary to prevent legal violations.
13. Applicable law and place of jurisdiction
German law applies excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the statutory places of jurisdiction apply. If the customer is a merchant or has no general place of jurisdiction in Germany, the place of jurisdiction is Hamburg.
14. Final provisions
If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
